All participants declare that they 

• have health insurance with coverage that is suitable and appropriate and valid in the respective country of travel and for outdoor sports (please check with your health insurance company before you start your trip whether insurance cover is provided for the corresponding outdoor activities according to the tour description);
• are up to the requirements according to the tour description on the website;
• there are no physical or medical concerns or restrictions for participation in outdoor activities. In the event of illness or other restrictions, participation must be discussed in advance with the responsible doctor. If there are any doubts about fitness for the tour, Wild Ventures must be notified before booking and a medical certificate must be provided to prove fitness. In any case, the guide must be informed of any relevant illnesses (e.g. diabetes, allergies, epilepsy) at the start of the tour. Any assistance measures must be explained and authorized, whereby the guide and the other crew members are to be released in writing with document “medication disclaimer” from any responsibility and/or liability in the context of any assistance measures.

All participants will be instructed before the tour on general behavior during the tour and how to use any equipment provided. Each participant is responsible for him/herself and must take the necessary personal safety measures, both in the accommodation and during any outdoor activities. Each participant is responsible for taking special safety precautions as the situation requires.

Likewise, all optional (bookable) activities associated with the tour (e.g. canyoning, via ferrata, vehicle hire, etc.) are carried out at the participant's own risk and as part of the booking with the respective third party provider. The guide doesn’t assume any responsibility for such optional activities. Any liability on the part of Wild Ventures and the guide for damages arising from such optional activities is expressly excluded. In addition, we would like to point out that participants bear the sole risk for excursions with rented means of transportation such as rental cars, snowmobiles, scooters, or quads, for which document “rental disclaimer” has to be signed.

If other outdoor activities are included in the tour offer, these are carried out exclusively by trained specialist staff and/or specialist companies whose instructions must always be followed. These activities are also the sole responsibility of the participants. The guide may take part in these activities but does not assume any instruction or liability for other participants.

A crew fund will be set up to cover the costs of food, fuel and other ongoing benefits resulting from the tour. It will be funded and shared equally by the participants. As is old tradition, the guide does not contribute to the crew fund. It is up to the crew to decide whether restaurant visits and optional activities are paid jointly from the crew fund or individually by the participants. The exact amount of the crew fund varies from crew to crew depending on personal preferences or, for example, the frequency of restaurant visits and activities. If a crew member has to leave early, it is the sole responsibility of the participants and not Wild Ventures or the guide to ensure that any differences in the amounts paid into the crew fund in are made up.

All participants and the guide are jointly responsible for the success of the tour. Living together in a group and the safe realization of the outdoor activities requires the attention and consideration of each participant  for the other crew members. By accepting the Crew Agreement as part of the booking, participants exclude any liability for damage to property caused by negligence. The exclusion of liability does not apply if damage was caused by gross negligence or intent or is covered by liability insurance.

IMPORTANT NOTE: Damage caused by a crew member to another crew member, or the guide is often not covered by private liability insurance, as many outdoor activities are usually so-called "hazardous sports" and liability in this context is often excluded by insurance companies. We therefore recommend that you inform yourself with your own insurance company beforehand whether such an exclusion exists. 

The guide is responsible for leading the tour on site and for the individual planning of the activities on site within the framework of the tour description, taking into account, for example, the weather situation and the individual performance of the crew, with the necessary caution, safety orientation and care.

The guide's instructions must be followed during the tour. The guide may entrust individual crew members with precisely defined tasks (e.g. as a "co-guide" and rearguard during hikes or as a contact person for a group that is temporarily split up due to different activities). No gross negligence can be derived from this behavior of the guide alone, provided that these tasks have been explained and can be reasonably expected of the participants. 

For safety reasons, the guide may prohibit the consumption of alcohol during the entire tour or on certain days. Otherwise, there is no general ban on alcohol, but each participant is responsible for observing his/her own subjective limits so as not to endanger him/herself or others, especially during the activities. 

Similarly, the guide may exclude individual crew members from participating in certain activities if there are justified safety concerns for themselves, crew members or third parties, regardless of previous failure to follow instructions.

The entire crew must ensure that the accommodation and equipment remain in perfect condition during the tour. The participants are also jointly responsible for both safe operation and safe use. In particular, means of transportation such as rental cars, canoes, bicycles or snowshoes must be secured or not left unattended. 

Damage culpably caused by crew members must always be compensated by the person who caused the damage. In the event of damage for which the person responsible cannot be identified and in the event of damage caused by slight negligence in the context of tasks in the interests of the community (washing up, cleaning, carrying canoes, cleaning bicycles, etc.), all crew members shall be jointly and in equal proportions liable if and to the extent that the damage is not covered by insurance vis-à-vis the rental company.

All instructions for careful handling must be followed. Any damage must be reported immediately to the guide. 

The guide is obliged to carry out the house/equipment handover (the so-called check-in and check-out) before and after the tour and to confirm its integrity and completeness with his/her signature if necessary and to report any defects to Wild Ventures. If possible, the guide should carry out the check-out when all participants are still present. 

IMPORTANT NOTE: If a participant departs before check-out, he/she must be aware that even if the equipment is visually in perfect condition, possible damage may be discovered at check-out and must be compensated by the crew. In such a case, compensation for damage will be settled after the tour by bank transfer among the participants.

All participants undertake to comply with German law as well as the respective national law of the destination country and to inform themselves about the applicable laws before the trip.

This also applies in particular to the consumption of alcohol, narcotics and other illegal substances during the tour.

This Crew Agreement shall be governed exclusively by the law of the Federal Republic of Germany to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG United Nations Convention on Contracts for International Sale of Goods of April 11, 1980) and the standards of private international law referring to it. Munich is agreed as the exclusive place of jurisdiction.

Should individual provisions of this agreement be or become invalid in whole or in part, this shall not affect the legal validity of the remaining provisions. In such a case, the crew members hereby undertake to reach a supplementary agreement which comes as close as possible to the invalid provisions in legal and economic terms. The crew members must reach a similar agreement if the provisions of this agreement should prove to be incomplete in any way.
